In the Netherlands, public prosecutors and judges are now in most cases women, while lawyers who defend criminals are almost all men. Considering the known facts on sex differences in intelligence as explained in my article of that title, this implies the lawyers will on average be of higher intelligence, and therefore greater ability, than the prosecutors and judges. In other words, the best experts are choosing the wrong side and helping to make crime profitable and keep criminals out of jail.
This is bad.
How it came to be is easy to guess; Criminals, especially the worst ones, can spend much on their defence. Money obtained through crime that has never belonged to them in the first place, obviously. This makes it interesting for lawyers to work for the underworld; They get rich quickly, and often achieve an almost pop star like status in their crime-sponsored Armani suits and Jaguar cars.
The way to change this and win the most able back for the righteous case is to make it impossible for criminals to pay lawyers with crime-generated money. In practice, this can be done by reclaiming a lawyer's fee when it is proven his client is guilty of a crime that earned him money. The question whether it is "the same" money is irrelevant.
When the law is changed to this effect, defending criminals will be less attractive to lawyers than it is now, and the scale of justice may slide back into balance.
